The Buyer and Seller shall hereinafter be referred to separately as “Party” and collectively as “Parties”.

2. SUBJECT OF THE AGREEMENT
The subject of this Distance Sales Agreement is to determine the rights and obligations of the Parties regarding the sale and delivery of the product or products ordered electronically by the Buyer through the bkistanbul.com website, within the scope of Law No. 6502 on Consumer Protection, the Regulation on Distance Contracts and other relevant legislation provisions.
The Buyer accepts that they have read and approved the preliminary information form regarding the basic characteristics of the products subject to the order, the sales price, payment method, delivery conditions and right of withdrawal, electronically.

3. PRODUCT AND PAYMENT INFORMATION
For the product or products subject to the order;

- Shipping fee
- Payment method
are determined in accordance with the information available in the system at the time the order is created.
Payment methods;
- Credit Card
- Debit Card
- Bank Transfer / EFT
- Other payment methods offered by the Seller
may apply.

4. DELIVERY
Products are delivered to the address provided by the Buyer during the order within the legal period after payment confirmation.
Public holidays, force majeure, natural disasters, transportation problems, and delays caused by shipping companies may affect the delivery time. In such cases, the Seller will provide the necessary information.
The Buyer is obliged to check the package during delivery. In the event of a crushed, torn or damaged package, a record should be kept by the cargo officer and the product should not be received.
It is accepted that the received product was delivered intact.

5. RIGHT OF WITHDRAWAL
The Buyer may exercise their right of withdrawal without giving any reason within 14 (fourteen) days from the date the product is delivered to them or to a person designated by them.
For the right of withdrawal to be exercised;
- The product must be unused,
- It must be in a resalable condition,
- It must be sent complete with its original packaging, accessories, and invoice.
Following the receipt of the returned product by the Seller within the scope of the right of withdrawal, the product price will be refunded to the Buyer within the legal period using the method by which the payment was made.

6. CASES WHERE THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED
Within the scope of Law No. 6502 and the Regulation on Distance Contracts, the right of withdrawal cannot be exercised for the following products:
- Products specially produced in line with the Buyer's requests,
- Opened, used, or non-resalable products,
- Products unsuitable for return due to hygiene reasons and with opened protective packaging,
- Single-use packaged products, products that come into contact with food and are not suitable for resale for hygiene reasons,
- Other products for which return is not possible according to legislation.

7. GENERAL PROVISIONS
The Buyer accepts that they have read and approved all information regarding the basic characteristics of the products, sales price, payment terms, delivery, and right of withdrawal before completing the order.
The Seller undertakes to deliver the products subject to the order completely, in good condition, and in accordance with the specifications stated in the order.
In the event that product stocks run out or cannot be supplied, the Seller may cancel the order by informing the Buyer and will refund the collected amount within the legal period.
The Seller cannot be held responsible for the delayed delivery of the product due to force majeure.

8. PERSONAL DATA
Personal data shared by the Buyer is processed solely for the purposes of preparing and delivering the order, carrying out customer service processes, and fulfilling obligations arising from applicable legislation.
Detailed information regarding the protection of personal data is regulated within the scope of the KVKK Clarification Text and Privacy Policy located on the bkistanbul.com website.

9. AUTHORIZED COURT
In disputes arising from this agreement, the Consumer Arbitration Committees are authorized within the monetary limits announced annually by the T.R. Ministry of Trade, and the Consumer Courts at the Buyer's or Seller's place of residence are authorized for disputes exceeding these limits.

10. EFFECTIVENESS
By completing their order through the bkistanbul.com website, the Buyer declares that they have read, understood, and electronically accepted all provisions of this Distance Sales Agreement.
This agreement enters into force with the electronic approval of the order.
